Shellcraft (Ka Hei's) Terms and Conditions

Welcome to Shellcraft. These Terms and Conditions govern your use of all our websites, progressive web applications (PWAs), tools, and any custom websites or applications developed by Shellcraft for anyone. This includes, but is not limited to, Shellcraft Forms Creator, TurtleDB, Snaplet, Globot, and any other Shellcraft-branded or Shellcraft-operated projects ("Shellcraft Services"). By using Shellcraft Services, you agree to these terms in full. If you disagree with any part of these terms, please do not use our service.

1. Acceptance of Terms

By accessing or using Shellcraft Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of Shellcraft Services after any modifications indicates your acceptance of the modified terms.

2. Description of Service

Shellcraft provides web applications, websites, and tools designed with a strong focus on user privacy. Our services may utilise artificial intelligence capabilities via external APIs, use Google Apps Script and Google Sheets as our services' servers, or other external libraries for specific functionalities. No app is perfectly secure, and thus you acknowledge that information may be intercepted or viewed from breaches or maintainance purposes.

Without limiting the generality of the above:

• TurtleDB is a movie and series database and discovery/search application that uses third-party APIs (such as The Movie Database “TMDB”) and may embed or redirect to external streaming providers via iframes or links. TurtleDB does not host video content itself and do not endorse these content.
• Shellcraft Forms Creator is a tool to generate self-contained, multi-step form pages as single HTML files.
• Other tools (such as Snaplet, Globot, and similar projects) provide client-side utilities, prototypes, and productivity tools.

3. Shellcraft Forms Creator

Shellcraft provides a tool known as the "Shellcraft Forms Creator," which allows users to generate self-contained, multi-step web forms as single HTML files. Use of this tool is subject to the general open-source license terms outlined in Section 6, as well as the following specific conditions:

• Mandatory Attribution: As a condition of using the Forms Creator, you must retain the "Powered by Shellcraft Forms" link and attribution in the footer of the generated HTML file. This reinforces the general license requirement detailed in Section 6.
• Data Collection & Privacy: You are solely responsible for the data you collect through any form generated by our tool. The forms are designed to send data to an endpoint of your choosing (e.g., a Google Apps Script). Shellcraft does not have access to, control over, or liability for this endpoint or the data transmitted to it. You are responsible for your own privacy policy and for complying with all applicable data protection laws.
• Disclaimer of Warranty: The Forms Creator and the forms it generates are provided "as is," without any warranty of any kind. Shellcraft is not liable for any data loss, security breaches, or other issues arising from your use of the generated forms or the third-party endpoints you configure.

4. User Conduct

You agree not to use Shellcraft Services to:

• Engage in any activity that violates applicable laws or regulations.
• Infringe upon the rights of others, including intellectual property rights.
• Distribute malware, viruses, or other harmful computer code.
• Generate or distribute illegal, harmful, or offensive content.


• If any of these listed above are found to be breached, Shellcraft reserve the right to the removal of your access without warning, as we do not collect your email address and could not contact you.

5. Content and Results from External Services

While we strive to provide a reliable interface, Shellcraft Services:

• Do not guarantee the accuracy or reliability of any results or content generated by external services.
• Are not responsible for content generated based on your inputs to external services.
• May provide links to third-party websites over which we have no control.

In particular, TurtleDB relies on:

• The Movie Database (TMDB) and potentially other metadata providers for titles, descriptions, ratings, and imagery.
• Embedded or linked third-party video providers that host or serve the actual media.

Shellcraft does not host, store, or control the video content embedded or surfaced through TurtleDB and is not responsible for the availability, legality, safety, or quality of any third-party content or services. You should exercise judgement when evaluating any information obtained through our applications and when interacting with third-party sites, and abide to Section 4.

6. Intellectual Property

All content, features, and functionality of Shellcraft Services, including but not limited to text, graphics, logos, and software, are the property of Shellcraft or the respective owners and are protected by intellectual property laws.

Use of Open-Source Projects

Shellcraft open-source services and software can be used for both commercial and personal purposes, subject to the following mandatory condition:

• Attribution: You must ensure that any public-facing instance of the software prominently displays the attribution "Powered by Shellcraft" for services that use Shellcraft products, or "Made by Shellcraft" for software/projects that are made by us (or a similar variant provided within the project), which must link back to the official Shellcraft website (https://kaheichan.neocities.org). This attribution must be retained if already present. If not present, it must be added in a manner consistent with the user interface (e.g., in the footer).

Failure to comply with this attribution requirement may result in legal action or other consequences under applicable laws.

7. Custom Projects & Websites

For any custom website, application, or digital product developed/designed by Shellcraft for a client, the following terms apply:

• Intellectual Property: All creative and functional components remain the perpetual intellectual property of Shellcraft (Ka Hei Chan), unless otherwise agreed in writing with Ka Hei's signature (either by pen and paper, or via a document).
• License to Use: Clients are granted a conditional, non-exclusive license to use the delivered product solely for the express purposes and scope agreed upon at project commencement, unless otherwise agreed in writing with Ka Hei's signature (either by pen and paper, or via a document).
• Copyright Notice: All components are protected under copyright law. No part may be copied or repurposed without express written permission.

Third-Party Content Disclaimer: Certain elements (e.g., client-provided text or licensed images) remain the property of their respective owners.

8. Third-Party Services

Shellcraft Services rely on third-party services for certain functionalities. These services have their own terms and privacy policies, and we are not responsible for their practices. By using Shellcraft Services, you acknowledge that data may be processed by these third-party services according to their policies.

Examples include, but not limited to:

• The Google DeepMind Gemini API and similar AI providers for AI-powered features.
• The Movie Database (TMDB) API for media metadata in TurtleDB.
• Google Apps Script and Google Sheets for persistence or syncing in Shellcraft Services.
• Embedded video players.
• Leaflet.js or mapping libraries where used.
• Your own configured endpoints (e.g., for Shellcraft Forms Creator) for form submissions.

9. Privacy

Your use of Shellcraft Services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference and can be found below.

10. Limitation of Liability

Shellcraft (Ka Hei) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service. We will also not be liable for any intellectual property right breaches that may appear in our website from external providers, and you have the responsibility to not breach copyright laws as per Section 4.

11. Disclaimers

Shellcraft Services are provided "as is" and "as available" without any warranties of any kind, either express or implied.

Without limiting the generality of the foregoing:

• We do not guarantee availability, uptime, or correctness of third-party providers.
• We do not endorse any external sites or content that may be embedded or linked.
• You are responsible for complying with local laws and third-party terms when accessing media through external providers.

12. Termination of Service

We reserve the right to discontinue or suspend access to our applications for conduct that we believe violates these Terms and Conditions without warning.

13. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Shellcraft operates.

Privacy Policy for Shellcraft Services and Websites

At Shellcraft, your privacy is paramount. This Privacy Policy outlines our approach to data across all Shellcraft Services, including but not limited to Shellcraft Forms Creator, TurtleDB, Snaplet, Globot, and any other Shellcraft-operated projects.

1. No Data Collection by Shellcraft

Shellcraft will not collect, store, or process any personal or non-personal data from your use of our websites or PWAs, beyond what is strictly necessary for basic, client-side functionality, such as personalised data shown after user login.

This includes:

• We do not operate first-party analytics, tracking pixels, or advertising beacons.
• We do not store your form submissions from Shellcraft Forms Creator, as forms post to endpoints you configure.
• We do not operate a central database of your TurtleDB watch history, ratings, or notes on Shellcraft-owned servers. Where TurtleDB offers “cloud sync” using Google Apps Script and Google Sheets, data is stored in that Google environment under the configured script/account, not on a Shellcraft-owned server.

Any data you see inside our tools is either:

• Stored locally in your browser (e.g., LocalStorage), or
• Sent directly to a third-party service that you configure or that the app depends on (see Section 3).

2. Local Storage of Data

Any data you input or generate within our applications is, by design, stored primarily on your device.

Examples:

• Shellcraft Forms Creator: configuration data may be stored in your browser to remember your last used settings. Actual form submissions are sent to your chosen endpoint and not to Shellcraft.
• TurtleDB: watchlist, notes, ratings, parental control settings, and similar preferences are stored in your browser’s LocalStorage and/or in your own Google Apps Script / Google Sheets backend when you enable "cloud sync".

You have full control over locally stored data (e.g., by clearing your browser storage).

3. Third-Party Services

Our applications may interact with third-party services for specific functionalities. When you use features that rely on these external services, data is sent directly to the respective third-party provider. Shellcraft does not intermediate or store this data.

Examples include:

• The Google DeepMind Gemini API or other AI APIs for AI-powered features (e.g., suggestions, completions).
• Leaflet.js or other mapping libraries for maps and geospatial features.
• Your self-configured data collection endpoints (e.g., a Google Apps Script) for forms generated with the Shellcraft Forms Creator. You control this endpoint, and any data sent to it is governed by your own privacy practices and the terms of that service (e.g., Google).
• The Movie Database (TMDB) API for TurtleDB, which provides metadata such as titles, posters, ratings, and descriptions. Your requests to TMDB may be visible to TMDB according to their own policies.
• Google Apps Script and Google Sheets backends used by TurtleDB or other tools when you opt into “cloud sync” or similar functionality. In these cases, data is stored in a Google account or Google Script you or Shellcraft configure.

We encourage you to review the privacy policies of any third-party services you engage with.

4. Our Commitment

Our development philosophy is centred on privacy and minimal data collection. We design our applications to maximise client-side processing and to avoid unnecessary central storage, ensuring that your digital footprint with Shellcraft remains as much as possible within your control.

5. Children and Safety

Shellcraft Services, including TurtleDB, may include parental control features (such as rating filters) aimed at helping guardians manage access to certain content categories. These features are provided as convenience tools only and should not be relied upon as a complete safety solution. We do not knowingly collect personal data from children, nor do we profile users.

Responsibility for safe use of Shellcraft Services, including decisions about which content to access or allow, rests with users and guardians.

6. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be posted within the applications and/or on our website. Your continued use of Shellcraft Services after such changes indicates your acceptance of the updated policy.
